E-Commerce in Vietnam: What to Watch Out for? | 11 December 2019

In recent years, with rapid urbanisation, high internet usage and a young population, Vietnam has become one of the top e-commerce markets in South-east Asia. According to DataReportal research, consumers in Vietnam spent roughly US$6 billion on online purchases in 2018, more than US$1 billion higher than the total for previous year. Shopee, Lazada, Tiki and Sendo have recently emerged as the most popular domestic online multinational platforms. Meanwhile, the world’s largest e-commerce marketplaces such as Amazon, eBay and Alibaba are also developing their roles for cross-border shopping in the Vietnamese market. As a fast and convenient tool, e-commerce enables various companies and individuals from multiple industries to easily sell and buy online.

An e-commerce boom has some important effects on the protection of intellectual property. The Internet brings opportunities to sell your product anywhere in the world using the big players’ platforms but also your own e-commerce website. In fact, more than the traditional retail market, e-commerce involves the selling of IP-rich products. Music, pictures, photos, software, designs, training modules, systems, etc. can all be traded through e-commerce, in which case, IP is the main component of value in the transaction. Moreover, IP law is one of the ways alongside technological security systems, to protect the IP treated on the Internet.

These opportunities come with some specific concerns, for example, the difficulty of monitoring counterfeit products and copyright violations. It is important to learn what steps you should take to protect your IPR, how you can protect yourself in this market, how to cooperate with e-commerce providers to take down the infringing products and how to enforce your IP rights in these kind of cases.
